Terms of Service
Terms and conditions governing the use of the Capital Gains Valuations website and the provision of property valuation services.
1. Agreement
These Terms of Service ("Terms") govern your access to and use of the Capital Gains Valuations website and any valuation services we provide. By accessing the website or engaging our services, you agree to be bound by these Terms.
2. Our Services
Capital Gains Valuations provides independent property valuation reports prepared by Certified Practising Valuers (CPV) for capital gains tax, deceased estate, SMSF, pre-sale advisory, and related purposes. Each engagement is governed by a separate written engagement letter that sets the scope, fee, and instructions.
Reports are prepared in accordance with the International Valuation Standards (IVS), the Australian Property Institute (API) Professional Practice, and relevant ATO guidance where applicable.
3. Engagement and Fees
Fees are quoted on a fixed-fee basis following review of the property, valuation date, and instructed CGT scenario. Quotes are valid for 30 days. Engagement begins on your written acceptance of the quote and engagement letter. Payment terms are set out in the invoice and are typically due on delivery unless otherwise agreed.
4. Reliance and Third Parties
Reports are prepared for the named client and stated purpose only. No other party may rely on the report without our prior written consent. We accept no liability to any third party who relies on a report without our authorisation.
5. Client Responsibilities
You agree to provide accurate, complete information about the property, its ownership, and the CGT event, including council records, plans, leases, improvement history, and any matters that could materially affect value. We are entitled to rely on the information you provide.
6. Intellectual Property
All copyright, trademarks, and intellectual property in our website, reports, templates, and methodology remain our property or that of our licensors. You may use a report you have commissioned for its stated purpose but may not reproduce, modify, or distribute it without our written consent.
7. Limitation of Liability
To the maximum extent permitted by law, our liability for any claim arising out of or in connection with our services is limited to the fee paid for the engagement to which the claim relates. We are not liable for any indirect, consequential, or economic loss. Nothing in these Terms excludes liability that cannot lawfully be excluded under the Australian Consumer Law.
8. Professional Indemnity
We maintain professional indemnity insurance consistent with API requirements. Details are available on request.
9. Confidentiality
We treat all client and property information as confidential and disclose it only as permitted by our Privacy Policy or as required by law.
10. Governing Law
These Terms are governed by the laws of Australia. The parties submit to the non-exclusive jurisdiction of the courts of the State in which our principal place of business is located.
